Registration

Customers must accept this contract and fill in the order form correctly. The customer is responsible for keeping their password confidential and must not pass it on to third parties. A customer who is a minor must first have parental consent to use our services. With or without that consent, any customer who is a minor accepts that they are responsible for their own actions.

Use

Putting unlawful files online (breach of copyright, pornography, piracy, abuse and so on), or files contrary to any national or international law, is strictly forbidden on our servers, on pain of the account being deleted without notice or refund. Misuse of the PHP mail() function for spam, sending viruses and the like will be penalised immediately. Customers' sites may contain any of the elements available to them on the web (graphics, audio, Java, JavaScript, PHP, HTML and so on).

Liability

Vestalicom cannot under any circumstances be held responsible for the content or the use of any of its accounts, nor for a failure of one of its machines that might cause losses to your company, association or other body. The customer must respect trade mark law and copyright, and undertakes not to use Vestalicom's services to store, distribute or promote viruses, trojans or any other program harmful to internet users. The customer alone is responsible for any direct or indirect harm, material or bodily, caused by the use of their account, and bears the consequences alone.

Information

Vestalicom may not pass on information about its customers except in the cases allowed by law. Every customer has the right to have data concerning them amended or deleted, and undertakes that the data is accurate.

Use of Vestaradio radio segments

Buying a pack of Vestaradio radio segments covers a single use by a single entity (a station, a company or any other user). Broadcasting the segments purchased is strictly limited to the entity that bought them. Reselling, transferring or redistributing the segments in any form whatsoever is forbidden without a prior commercial agreement with Vestaradio. Any breach of this rule may lead to legal action and to services being suspended immediately without refund.

Amendment

Vestalicom reserves the right to amend the terms and conditions of sale of its shared hosting service at any time.

Termination

Vestalicom reserves the right to terminate the contract within 7 days of it being signed, without having to give reasons. Any refund will be made within one month at the latest. Termination takes effect immediately upon written notice being sent to the customer.

Suspension

Vestalicom may have to suspend its activity following an event of force majeure: earthquake, war, act of terrorism, fire, flood, storm, strike, or failure of public or telecommunications networks that could affect the proper running of its infrastructure.

Streaming

Vestalicom accepts no responsibility for the streams broadcast. The customer must clear the rights if they broadcast tracks they do not own the rights to.

Account creation

Accounts are activated within 48 hours of payment being received, and an email is sent to the customer with all the information relating to their plan.

Payment terms

For all its plans Vestalicom accepts payment by cheque, bank card, bank transfer and postal order.
Proof of identity may be requested before or after your account is activated, for any payment through PayPal (bank card) or by bank transfer, in order to confirm your identity.
Five days before the account expires, an email is sent to the customer to warn them. They then have 2 days to renew it.
Once that period has passed with no word from them, the account is suspended for 24 hours. Once that further period has passed, the account is deleted from our servers.
If you want to stop using Vestaradio services on a recurring payment, please tell Vestaradio by phone, email or post.

Right of withdrawal

By subscribing to a web radio service on Vestaradio, and given that the service is supplied immediately, you expressly waive your right of withdrawal in accordance with article L.221-28 1° of the French Consumer Code.
